Criminal Operational Intelligence Records (Exempt bank)

Description:This bank contains personal information on individuals who have been implicated, following criminal investigations, in organized and other serious crime such as drug trafficking, securities fraud, corruption, counterfeiting, extortion, gambling, loan sharking, pornography and prostitution. Also included in this bank are records containing personal information concerning administration, policy and management of confidential human sources and witnesses requiring protection relating to criminal operations. This bank contains investigations and occurrence reports, statements and related documentation. This bank is designated by the Governor-in-Council as an exempt bank pursuant to Section 18(1) of the Privacy Act, on the basis of section 22 of the Act. Information in this bank may be maintained in hard copy files as well as in automated form such as Police Information Retrieval System (PIRS), Police Reporting Occurrence System (PROS), Police Records Information Management Environment (PRIME) National Criminal Data Bank (NCDB), and "E" Division Evidence and Reports Data Warehouse (E&RDW).

Class of Individuals: Individuals implicated in, or who are connected with and are the subject of criminal investigations including confidential human sources and witnesses.

Purpose: Compiled in the administration or enforcement of the law and in the detection, prevention or suppression of crime generally.

Consistent Uses: The information is used by accredited domestic and foreign law enforcement and investigative agencies in the administration or enforcement of the law and in the detection, prevention or suppression of crime generally. Personal information concerning human sources and witnesses is used in the administration and management of these individuals. This information is also used by federal departmental security officers for security and reliability screening, as well as for research, planning, evaluation and audit, statistical purposes and may be matched with information from other personal information banks and/or program records. All linkages for the purpose of administration or enforcement of the law and in the detection, prevention or suppression of crime are in compliance with the provisions of the Privacy Act.

Retention and Disposal Standards: Information in this bank is retained by the RCMP for a minimum of two years. If the file has been designated as having enduring value it will be transferred to the control of Library and Archives Canada, otherwise it will be retained by the RCMP until it no longer has business value. At that point, it will be destroyed.

National Security Investigations Records (Exempt bank)

Information in this bank is entirely searchable but can be restricted from the view of certain user groups depending on the sensitivity and a user's requirement to see the information. In addition to the requirements indicated on the Personal Information Request Form, individuals must provide their full name, date of birth and the location where the investigation occurred. Individuals wishing to access only specified information should identify the material desired to expedite the processing of their requests. Personal information contained in LIMS-Plus is minimal (Surname, Given Name 1, Given Name 2, Date of Birth, Sex and Subject Type and complies with PIRS (Police Information Retrieval System) requirements for reporting) and is monitored/managed respecting the regulations for the storage and retention of information under the Library and Archives of Canada Act and Privacy legislation. LIMS-Plus also contains DNA profiles generated from crime scene evidence. LIMS-Plus operates in a Protected 'B' security environment via Contivity and subject information for Protected 'C', Secret or Top Secret is not entered or maintained in the LIMS-Plus system. LIMS-Plus administration has a feature to 'sequester' information if required for sensitive case information to restrict access to data to a specific user.

Class of Individuals: Individuals involved in or the subject of criminal, municipal, provincial and federal statute investigations.

Purpose: Compiled in the administration or enforcement of the law and in the detection, prevention, or suppression of crime generally. Information in this PIB is collected in accordance with section 18 of the RCMP Act and section 17 of the RCMP Regulations. As per Treasury Board Directive on Social Insurance Number (SIN) in respect of Lawful investigation and SIN collection and use, the SIN is used only for the following purposes: to establish the accurate identification of an individual; to aid in the identification of a deceased person and locate their next-of-kin; or to identify and locate the owner of lost or stolen property that has a SIN inscribed.

Consistent Uses: This information is used by accredited domestic and foreign law enforcement and foreign investigative agencies, departments of the Criminal Justice System and Courts in the administration or enforcement of the law and in the detection, prevention, or suppression of crime generally. This information is also used by federal departmental security officers for security and reliability screening. Records are created by RCMP recruiting units that reflect indices checks that are conducted in order to determine the suitability of applicants for the RCMP. Firearms officers have access to a subset of information in PIRS, PROS, PRIME and Halifax RMS in order to administer the Firearms Program. In fact, firearms officers have direct access to a limited subset of information in PIRS. This data is used to supplement information in the Firearms Interest Police (FIP) category of the Canadian Police Information Centre (CPIC), in accordance with the general criteria set forth in subsection 5(2) of the Firearms Act. This information may also be used for investigations arising from public complaints (RCMP PPU 085), code of conduct investigations (RCMP PPE 805), research, planning, training, evaluation and audit, statistical purposes and may be matched with information from other personal information banks and/or program records. All linkages for the purpose of administration or enforcement of the law and in the detection, prevention or suppression of crime are in compliance with the provisions of the Privacy Act. Information collected and stored in the National DNA Bank may be shared with Interpol, Canadian Criminal Real Time Identification Services (CCRTIS), CPIC, public forensic laboratory and National Police Services (NPS).

Retention and Disposal Standards: Information in this bank is retained by the RCMP for a minimum of two years. If the file has been designated as having enduring value it will be transferred to the control of Library and Archives Canada, otherwise it will be retained by the RCMP until it no longer has business value. At that point, it will be destroyed or made anonymous if kept only for statistical and research purposes. Information in the Crime Scene Index (CSI), in the Convicted Offender Index and DNA samples (bodily substances) will be destroyed in accordance with sections 8.1 to 10.1 of the DNA identification Act.

Description: This bank contains information on individuals who have been a victim of crime or trauma. The personal information collected includes name, address, telephone number, age and gender. Information in this bank may be maintained in hard copy as well as automated form in operational records management systems such as the Police Reporting and Occurrence System (PROS) and the Police Records Information Management Environment (PRIME-BC).

Class of Individuals: Individuals involved in criminal, municipal, provincial and federal criminal justice systems. This includes victims of crime or trauma (adult or minor) or their next of kin.

Purpose: The information in this bank is used to provide a continuum of service to victims of crime or trauma as part of the criminal justice process. Limited personal information collected will be provided to Victim Services organizations as part of the victim services referral process to which the RCMP complies.

Consistent Uses: The information is used by the RCMP in the administration or enforcement of the law and in the detection, prevention or suppression of crime generally.

Retention and Disposal Standards: Records in this bank are retained for a minimum of two calendar years. Passenger Protect Program - Specified Persons List

Description: This bank describes information relating to the Passenger Protect Program, and in particular, to the Specified Persons List (SPL). Personal information may include name, contact information, biographical information, citizenship status, passport/visa/residency document number, any other known government issued identification number or document, any known financial and financial information, descriptions of individuals including photographs, descriptions of known or suspected acts or activities of the individual, any known fraudulent documentation presented or used by the individual, any known affiliations with terrorist or criminal organizations, any known criminal record, and travel details, such as name of the travel agency and agent, whether the flight ticket is one-way, and itinerary cities where the person will embark. Schedule A of the Aeronautics Act (AA) provides details of the specific information that may be collected.

Class of Individuals: Individuals who have been deemed by Transport Canada (TC) to pose an immediate threat to aviation security.

Purpose: The information is used to establish the Specified Persons List, and to assist Air Carriers in cases where police presence is required. The Information is used by RCMP employees designated by the Commissioner pursuant to subsection 4.82(4) of the Aeronautics Act for the purpose of transportation security

Consistent Uses: Information from intelligence reports and other correspondence is shared with Transport Canada to establish the Specified Persons List (Passenger Protect Program - Specified Persons List, Personal Information Bank (DOT PPU 001). Information provided to RCMP by TC under section 4.82 of the AA may be used by RCMP in the conduct of investigations under the Criminal Code and the Anti-terrorism Act when it has been deemed there is an immediate threat to transportation security. In the event the information is disclosed by a designated person to another person within the RCMP pursuant to subsection 4.82(8) or (9) of the AA, the information may also be used for maintaining the peace and the prevention and suppression of crime in general. Data may be matched with other personal information in RCMP operational files on Secure Police Reporting and Occurrence System (SPROS), Police Reporting and Occurrence System(PROS), Police Information Retrieval System (PIRS), Secure Criminal Information System (SCIS), National Criminal Data Base (NCDB), and Canadian Police Information Centre (CPIC). Urgent disclosure to a person in authority, pursuant to Section 4.82(10) AA may occur when a designated person has reason to believe that there is an immediate threat to transportation security or the life, health or safety of a person and that the person to whom the disclosure is to be make is in a position to take measures to respond to the threat and needs the information to respond.

Retention and Disposal Standards: In accordance with section 4.82(14) of the AA, information that does not clearly match information relating to entries on the Specified Persons List (SPL) will be destroyed within 7 days after it is provided. In the case of matches with information pertaining to RCMP entries on the SPL, this information becomes part of RCMP holdings and is subject to the retention and disposal schedules affecting all other operational information holdings on SPROS. Also pursuant to section 4.82(14), where information is being disclosed to RCMP, a record will be prepared and kept setting out the reasons why this information is being retained by RCMP and shall be made available for yearly review by the Commissioner pursuant to section 4.82(15) of the AA. Information may be used for audit, evaluation, research, and/or statistical purposes.

The Protective Policing Clients & Partnership Retrieval System (PPCPRS) is a data base used as a communication tool to provide timely information and intelligence to RCMP members and partners. This automated system ensures the safety of our protectees and the security of Canadian interests. In addition to the requirements indicated on the Personal Information Request Form, individuals must provide their full name, date of birth and the geographic location where the information search is to be conducted.

Class of Individuals: The information relates to any person considered a threat or possible threat and victims of threats or possible threats.

Purpose: This information was compiled to assess whether or not given individuals pose a threat or are victims of threats as well as for the purposes of administration and enforcement of the law and detection and prevention of crime.

Consistent Uses: This information is used by domestic and foreign law enforcement agencies in the administration and enforcement of the law and in the detection and prevention of crime. National Sex Offender Registry

Description: This bank describes information about convicted sex offenders who are ordered through the courts to report annually and under other specific circumstances to the National Sex Offender Registry (NSOR). Personal information may include, name(s), date of birth, Finger Print Serial (FPS) number, current and historical mailing address(es), telephone number(s), race, physical attributes, employer's name, employment type and title, volunteer organization, volunteer type and title, vehicle description registered to or regularly used, sexual offence history, method of operation in relation to the sexual offences, victim information (age, gender and relationship to the offender, as required under the Sex Offender Information Registration Act), conviction dates and locations, passport(s) and issuing jurisdiction, drivers licence(s) and issuing jurisdiction, departure and return dates and all addresses/location for travel both inside and outside Canada, and any aliases.

Class of Individuals: Individuals who have been convicted of a designated sex offence (Section 490.011 Criminal Code) and have been subsequently ordered to register with the National Sex Offender Registry or individuals who were under sentence on the day on which the Sex Offender Information Registration Act was proclaimed (December 15, 2004) and have received a Notice of Obligation or Obligation to Comply with SOIRA. The sex, age of all related victims and the nature of the victim/offender relationship is collected and held on the offender's record within the registry.

Purpose: Information contained in the National Sex Offender Registry is used to support accredited Canadian police agencies in preventing and investigating crimes of a sexual nature.

Consistent Uses: This information may only be used in accordance with the Sex Offender Information Registration Act. Information on dependants is used when determining suitability of the member for postings in certain geographic areas, when they accompany the member and/or compassionate postings based on medical grounds or to determine suitability of the member to serve in a foreign posting.

With respect to Other Persons Applying to Serve in Foreign Policing to determine their suitability to perform such duties, and monitor their continued physical health/mental health conditions while performing those policing duties to provide a composite record of physical health/mental health conditions, injuries and treatment related to those duties.

Early Warning Integrated Risk Management Program (EWIRMP)

Description: This bank describes information, by way of a chronological overview, about individuals involved in Public Complaints, Code of Conducts and Police Motor Vehicle Collisions. The Early Warning: Integrated Risk Management program has been developed to provide a tool to identify and pro-actively address issues which may be impacting a member's conduct/performance at work in the RCMP. Information in this bank is maintained in the Internal Affairs Professional Standards Software (IAPro) an automated human resources management system, used by the Professional Standards Unit. The personal information captured includes the individual's full name, position, title, location of unit, date of occurrence, summary of occurrence, disciplinary actions, public complaints and findings, employee identification number, employee personal information. File attachments may include: Images, videos, audio linking for analysis.

Class of Individuals:All Regular and Civilian members of the RCMP in "K" Division and "E" Division.

Purpose: The personal information is used to administer the early warning: integrated risk management program or activity. Personal information is collected pursuant to sub-paragraph 21(1)(b) of the RCMP Act and its Regulations. The information may be used or disclosed for the following purposes: to enable appropriate intervention strategies to be implemented by Senior Management in an effort to prevent further incidents that could impact the welfare of the member and to prevent further risk to the Force; and provide statistical output to the provincial authority in the province as per PART VII, Public Complaints in the Royal Canadian Mounted Police Act and Regulations.

Consistent Uses: This information is also used to produce management reports as well as research, planning, evaluation and audit, statistical analysis and mandatory legislative reporting.
