On March 13th, 2017, Donald James Lutes, a 28 year-old male from Charlottetown, appeared in Summerside Provincial Court and was sentenced to 30 months in jail following his sentencing on a charge of operating a motor vehicle while impaired causing death, contrary to Section 255(3) of the Criminal Code.
The single motor vehicle crash occurred on the 24th of October 2015 in the North Tryon area, which resulted in the death of Matthew Gallant, a resident of Amherst Nova Scotia. The crash had closed the Trans Canada Highway for a number of hours while RCMP, Island EMS, the Crapaud Fire Department assisted an accident reconstructionist on scene.
Mr. Lutes, was also prohibited from operating any motor vehicle in Canada for a period of 60 months and was required to submit his DNA to the National DNA bank.
