On April 8, at approximately 11:30 p.m., Annapolis District RCMP responded to a report of a disturbance at a residence on Nictaux Falls Rd. in Nictaux Falls.
Upon arrival at the scene, RCMP officers located a 21-year-old woman outside the home; she reported that a man and a woman were inside the residence and that the woman was being assaulted by the man.
While officers were speaking with the woman, a man came out of the home, got into an SUV and fled the area. Officers were unable to stop him. Then the 21-year old woman left on foot.
RCMP officers went inside the residence, spoke with a 44-year-old man and a 44-year-old woman, and confirmed there was no assault in progress.
Officers learned that the woman who they had spoken to outside the home had attended the residence earlier that night with two men. The three individuals forced their way into the home and assaulted the 44-year-old man and 44-year-old woman, who were known to them. During the assault, the victims, who suffered non-life-threatening injuries, were threatened with a firearm and forced to hand over the keys to their SUV.
Shortly after taking off, the 21-year-old woman was located at a nearby business and safely arrested.
The stolen SUV, which contained a rifle, was later found abandoned in Greenwood. The vehicle and firearm were seized for forensic analysis.
Information gathered by investigators indicated that the trio arrived at the Nictaux Falls Rd. residence in a truck that had been reported stolen from East Hants earlier in the day. The truck, which contained a shotgun, was left at the scene; that vehicle and firearm were also seized for forensic analysis.
On April 9, Kings District RCMP, with the assistance of Annapolis District RCMP, Kings District RCMP Street Crime Enforcement Unit and RCMP Police Dog Services, arrested the two men involved in the assault at a motel located on Main St. in Kingston.
During the arrest, one of the suspects attempted to flee but was apprehended by the police dog. He was treated and released from hospital. The police dog was not injured. The second suspect surrendered but attempted to flee while in handcuffs. He was apprehended after a short distance with the assistance of a bystander.
A search warrant was subsequently executed and officers located and seized a rifle, ammunition, a scope, and the keys to the stolen SUV.
Brooke Alexis Timpa, 21, Mitchell Larry Budd, 26, and Matthew James Pipher, 24, have been charged with:
• Wilfully Obstructs a Peace Officer
• Assault Causing Bodily Harm (two counts)
• Robbery with Firearm
• Breaking and Entering Committing Indictable Offence;
• Unauthorized Possession of Firearm
• Possession of Property Obtained by Crime of a Value Exceeding $5000.00
• Possession of Property Obtained by Crime of a Value Not Exceeding $5000.00
• Using Firearm in Commission of Offence
• Pointing a Firearm
• Possession of Firearm Knowing its Possession is Unauthorized
• Uttering Threats (two counts)
Additionally, Timpa has been charged with:
• Failure to Comply with Probation Order (two counts)
Additionally, Budd has been charged with:
• Failure to Comply with Probation Order (three counts)
• Failure to Comply with Release Order (five counts)
• Unauthorized Possession of Firearm
• Possession of firearm knowing its possession is unauthorized
• Mischief
• Resist a Peace Officer
• Escape and being at large without excuse
Additionally, Pipher has been charged with:
• Unauthorized Possession of Firearm
• Possession of firearm knowing its possession is unauthorized
• Mischief
• Resist a Peace Officer
Timpa appeared in Annapolis Royal Provincial Court on April 9 and was remanded in custody. She returns to court on April 17 at 9:30 a.m.
Pipher and Budd appeared in Annapolis Royal Provincial Court yesterday and were remanded in custody. They return to court on April 25 at 9:30 a.m.
The investigation is ongoing.
